1. Acceptance of Terms
These Terms and Conditions ("Terms") govern your use of XIRCLE ("XIRCLE", "we", "our", or "the App"), developed by CLOVERX (THAILAND) COMPANY LIMITED. By signing in, creating an account, tapping "Agree", or using the App, you agree to these Terms.
If you do not agree to these Terms, do not use the App.
2. About XIRCLE
XIRCLE is a wellness and sleep-tracking mobile application that helps users view sleep-related information and connect to a compatible Bluetooth wristband.
The App may display sleep duration, sleep stages, activity, heart rate, SpO2, HRV, and related wearable metrics when available. Availability depends on compatibility, connection, sensor quality, and how the device is worn.
3. Accounts and Login
XIRCLE may support login with Google, login with Apple, and demo access.
You are responsible for activity under your account and for keeping access to your Google or Apple account secure. Demo access may use sample data that should not be treated as your personal health data.
4. New User Agreement Flow
New users may be asked to review and agree to these Terms and the Privacy Policy after login and before using the App's main features. If you do not agree, stop using the App.
5. Bluetooth Device Connection
Some features require a compatible Bluetooth wristband. Bluetooth permissions are used to discover, connect to, and exchange data with the device.
We do not guarantee compatibility with every wearable. Depending on its firmware, a wristband may connect to only one app or device at a time.
6. Health and Wellness Disclaimer
XIRCLE is a wellness application. It is not a medical device.
The App is not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition.
Consumer wearable sensors can be inaccurate or unavailable due to device fit, skin contact, movement, battery level, Bluetooth connection, firmware behavior, and other factors.
Do not use XIRCLE as a substitute for professional medical advice, diagnosis, or treatment. Consult a qualified healthcare professional for medical concerns and contact emergency services if you believe you may have a medical emergency.
7. User Responsibilities
You agree not to:
- Use the App for unlawful purposes
- Interfere with or disrupt the App, backend systems, or connected services
- Attempt to gain unauthorized access to another user's account or data
- Misrepresent health data or use the App in a way that could harm others
- Reverse engineer or misuse Bluetooth communication for malicious purposes
8. Data and Privacy
Your use of the App is also governed by the XIRCLE Privacy Policy, which explains what information the App collects, how it is used and stored, and how users can request deletion.
9. Account Deletion
You may request account deletion from within the App or by contacting support. We will delete or de-identify account and profile data from active systems, subject to legal, security, fraud-prevention, and backup requirements.
Account deletion is targeted for completion within 30 days after confirmation.
10. Changes to the App
We may add, remove, or change features over time. If a future version changes how the App processes data or introduces material terms, we will update these Terms and/or the Privacy Policy.
11. Third-Party Services
The App may use third-party services such as Google Sign-In, Sign in with Apple, hosting providers, and backend infrastructure providers. Your use of those services may also be governed by their own terms and policies.
12. Availability
We do not guarantee that the App will always be available, uninterrupted, secure, or error-free. Features may depend on network access, Bluetooth availability, backend availability, and device compatibility.
13. Intellectual Property
The App, including its software, design, interface, logos, and content, is owned by or licensed to XIRCLE and CLOVERX (THAILAND) COMPANY LIMITED. You may not copy, modify, distribute, sell, or reverse engineer any part of the App except as allowed by law or with written permission.
14. Limitation of Liability
To the maximum extent permitted by law, XIRCLE and CLOVERX (THAILAND) COMPANY LIMITED will not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the App or reliance on information displayed by the App.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
15. Governing Law
These Terms are governed by the laws of Thailand, unless applicable consumer-protection laws require otherwise.
